1. Who we are

FOTO! FOTO! is operated by Nternet Company B.V., Keizersgracht 241, 1016 EA Amsterdam, KvK 96112107 ("we", "us", "our"). You can reach us at fotofoto@nternet.company.

By using FOTO! FOTO! you agree to these terms. If you don't agree, please don't use the service. You must be at least 16 years old to use FOTO! FOTO! (UAVG Art. 5).

2. What FOTO! FOTO! does

FOTO! FOTO! is a photo book service. You upload your photos, our system arranges them into a book layout using their metadata (dates, locations), you review and approve the design, and if you want, you order a printed copy.

  • Local-first. Your photos live in your browser until you decide to share or order. Before that point, we don't have your photos on our servers.
  • Automated layouts. We use your photo metadata (dates, GPS locations) to group and arrange your photos chronologically. No photo data is sent to external services for layout generation.
  • Sharing. You can generate a link to share your book with others. Anyone with the link can view it.
  • Printing. We partner with Prodigi to print and ship physical books.

3. Your account

You sign in with your email address. We send a one-time code, no passwords. You must provide a valid email address and keep your access secure.

You can delete your account at any time from the Account page. This permanently removes all your books, photos, and personal data from our servers. Active orders will still be fulfilled.

4. Your photos and content

You own your photos

You keep full ownership of everything you upload. We don't claim any rights over your photos.

License you grant us

By uploading photos, you give us a limited license to store, process, display, and print your photos, solely to provide the service. This license ends when you delete the content or close your account.

Your responsibility

You must have the right to use every photo you upload. You agree not to upload:

  • Content you don't own or have permission to use
  • Photos of people who haven't consented (where legally required)
  • Illegal, harmful, abusive, or hateful content
  • Child exploitation material (zero tolerance, we report to authorities)

We may remove content that violates these terms and suspend or terminate accounts that do so repeatedly.

5. Sharing

When you share a book via a public link, anyone with that link can view it. You can revoke the link at any time to make your book private again.

6. Orders and payment

Pricing

All prices are shown at checkout and include the book, shipping, and any applicable fees. You see the total before you pay.

Payment

Payments are processed by Stripe. Your card details go directly to Stripe and never touch our servers. By placing an order, you authorize the charge for the full amount shown at checkout.

Order confirmation

After payment, you'll receive an email confirmation. Your order enters production immediately.

7. Custom products and cancellation

Every photo book is a custom product made to your specifications with your personal photos. Under EU consumer law (Article 16(c) of the Consumer Rights Directive / Art. 6:230p(f)(1) BW), custom and personalized products are exempt from the 14-day right of withdrawal.

Once you place your order and production begins, it cannot be cancelled. Please review your book carefully before ordering.

8. Shipping and delivery

Books are printed and shipped by our partner Prodigi. Delivery times depend on your location and the shipping method available. We'll send you tracking information once your book ships.

We cannot guarantee delivery dates. If your order cannot be shipped within 30 days of confirmation, you may cancel for a full refund.

9. Defects and quality guarantee

We guarantee that your book will be free from manufacturing defects and printing errors. If you receive a defective product:

  • Contact us within 30 days of delivery at fotofoto@nternet.company with photos of the defect
  • We'll review your claim within a few business days
  • If approved, we'll reprint and ship a replacement at no cost, or provide a full refund

What's not covered

  • Subjective dissatisfaction with layouts you approved before ordering
  • Color differences between your screen and the printed product (screens and printers render color differently)
  • Low-resolution source photos resulting in reduced print quality
  • Normal wear and tear

10. Layout disclaimer

Our system generates layout suggestions based on your photo metadata (dates, locations, camera info). These are algorithmic suggestions, not human creative work. Results may vary and may not always match your expectations.

You have full opportunity to review and modify layouts before ordering. The system does not edit, alter, or generate your actual photos, only their arrangement on the page. We make no guarantees about the aesthetic quality of generated layouts. Final approval before ordering is your responsibility.

11. Data and privacy

For full details on what data we collect, why, and who processes it, see our Privacy Policy. Our Data Processing Agreement applies where the GDPR requires one.

12. Communications

We send transactional emails only: login codes, order confirmations, and shipping updates. We don't send marketing emails.

13. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim arose.

This doesn't affect your statutory rights as a consumer under EU or Dutch law (BW 6:237).

14. Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll notify you by email or by placing a notice on the site. Continued use of the service after changes take effect means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the Netherlands. Any disputes will be resolved by the competent courts in the Netherlands, without prejudice to your rights as a consumer to bring proceedings in your country of residence (Brussels I bis Art. 17-19).
